The Romford County Court
In summer 2016, I was at the sitting hall of the Romford County Court, waiting eagerly for the hearing, while my tenant was on the other end. I am amid Tenant Eviction Nightmare.
‘Don’t worry. Just stay calm,’ said my agent.
It was the second hearing after the first one, a year ago. Mary (not her real name), my tenant, has served with a Section 21 Notice on 23rd November 2014. A legal notice that a landlord gives to start the process to end an Assured Shorthold Tenancy (AST), under the small court claim.
However, the situation did not improve and time dragged on; it swelled to 8 months rental in arrears. As my tenant was on benefits from the council, when any of the household members work, there would be a certain percentage of auto deducting of rent to the landlord from the local council. The tenant will have to top up the arrears to the landlord. However, by 2016, the council has stopped the rental payment completely.
Mary and her partner will have many excuses for sorting out the problem with the council for over 2 years with excuses of being too busy with their life and cancelled many appointments with my agent in sorting the issue out. We were trying whatever we could to help them. To assist them. To support them to get to the council, but they seemed not to be bothered at all and took things for granted.
The Legal Eviction
Spring of 2017, the Small Court Claim has transferred this matter to the High Court for enforcement, under section 42 of the County Court Act 1984. So, we had a possession order to evict the tenant legally.
8.00 am 19th June 2017, bailiffs arrived at the property and started the eviction process. So the tenant took whatever they have and left peacefully. The bailiffs changed all the locks and left the premises vacant. The property was in a glorious mess. It was really a ‘Tenant Eviction Nightmare’.
Moral of the Story
Sign of relief, yet sad, but some great lessons learned.
Eviction was expensive
A very long-drawn-out process
Arrears of non-retrieved rent
Throw emotion out of the window and stick to strict business
Thorough tenant reference checks
